2010 Summary of Legislation – Effective January 1, 2011
- AB 1659 Huber (Chapter 666, Statutes OF 2010)
- Joint Sunset Review Committee - Makes every "eligible agency" of State government submit to a periodic review to determine if the agency is still necessary and cost effective. (Adds Article 7.5, commencing with Section 9147.7, to Chapter 1.5 of Part 1 of Division 2 of Title 2 of the Government Code).
- AB 1757 Monning (Chapter 450, Statutes OF 2010)
- VA Cemetery at Fort Ord - Requires local agencies to work with the federal government to design, develop, and construct the California Coast Veterans Cemetery at Fort Ord in Monterey County. (Amends Sections 1450, 1451, 1453-1457 of the Military and Veterans Code and adds Sections 1450.1 and 1450.2).
- AB 1770 Galgiani (Chapter 578, Statutes OF 2010)
- Vital Record fees - Until January 1, 2016, Stanislaus County can increase fees by up to $2 on certified copies of marriage, birth, fetal death, and death certificates to assist with domestic violence efforts. (Adds Health and Safety Code Section 103628.6 and Welfare and Institutions Code Section 18309.8).
- AB 1969 Jeffries (Chapter 40, Statutes OF 2010)
- Elsinore Valley Cemetery District - Adds to the Elsinore Valley Cemetery District the section known as Home of Peace, and by the addition of this section allows for 536 additional interments requiring endowment care and nonresident fees. (Adds Health & Safety Code Section 9063.5)
- AB 2130 Huber (Chapter 670, Statutes OF 2010)
- Sunset Review - Abolishes the Joint Committee on Boards, Commissions, and Consumer Protection and replaces it with the Joint Sunset Review Committee established by AB 1659. (Repeals Business and Professions Code Section 101.1 and Division 1.2, commencing with Section 473).
- SB 1222 Wolk (Chapter 520, Statutes OF 2010)
- Vital Record Fees - Until January 1, 2012, Solano County can increase fees by up to $2 on marriage licenses and certified copies of marriage, birth, fetal death, and death certificates to assist with domestic violence efforts. (Amends Government Code Section 26840.00, Health and Safety Code Section 103628, and Welfare and Institutions Code Section 18309.5).
- SB 1491 Committee On Business And Professions (Chapter 415, Statutes OF 2010)
- Keepsake urns - Defines a keepsake urn as a closed durable container that accommodates not more than one cubic centimeter of cremated remains. Allows keepsake urns to be kept by the person(s) with the right to control disposition under Health and Safety Code Section 7100, provided that a disposition permit is issued for each keepsake urn. (Amends Health and Safety Code Section 7054.6).
- Cremation Disk, Tab, or Label - Requires crematories to use the crematory license number in addition to a unique number on the identification disk, tab, or other permanent label for identification of cremated remains. The disk, tab, or label requirement does not apply to cremated remains in a keepsake urn if space does not permit. (Amends Health and Safety Code Section 8344).
- Crematory licensure - A crematory is no longer required to be on the grounds of a cemetery in order to be licensed (Repeals Health and Safety Code Section 8340).
